Intellectual Property is an invention created from the human mind. It can be a physical invention made from your idea, a trade mark, a design or a brand made for your business.

Intellectual Property Infringement is when someone uses any work which belongs to you without your consent or passes off their work as if it belongs to your brand, thus causing damage to your brand's reputation.

For example, if you own a design and upload it on your website. If someone uses your design without your consent, he may have infringed upon your Copyright.

Manufacturing for commercial purposes, possessing, sale and distribution of infringing items is a criminal offence in Singapore that may carry imprisonment of up to five (5) years.

Typically for published works that are written, musical or artistic the copyright protection lasts 70 years.

Unlike a Trademark or a Patent, you do not need to register a copyright in Singapore. The Copyright belongs to you automatically once the work is created.

Intellectual Property Law in Singapore is complex; there are various details in each case that will substantially affect the outcome of a matter. At Emerald Law, our intellectual property lawyers will be able to analyse your matter and give you an insight on your case. This allows you to see the strength in your case and allows you to decide if a case is worth pursuing.

It is best to contact a lawyer specialising in Copyright to review the matter. Copyright disputes are very technical, and the outcome of the case is dependent on the facts of the case and the supporting evidence. Speak to one of our Lawyers who specialises in Intellectual Property today.

The owner of the Copyright may still have the intellectual property right of the items posted online. As such, do not make the assumption that the item availability online automatically grants you the right to copy and use the Copyright. The owner may still enforce his right against you and seek for damages and reimbursement against you.

You may wish to contact them and attempt a resolution with the owner of the Copyright. The owner of the Copyright may give you permission to use the copyright, i.e. a license. However, take note that the owner will usually charge a fee for the usage of the Copyright.

The law for the protection of Copyright differ from country to country. You may wish to seek legal advice from an Intellectual Property lawyer in the said country if you wish to protect your Copyright in the particular country.
